Charged with felonies in Georgia, pain doctor still practicing in Jacksonville
A Jacksonville doctor with a pain clinic in Savannah, Ga., was charged with two felonies related to prescribing medication in Georgia early this month.
Shortly after posting $16,000 bond, Derek Beresford Thorpe returned to work at his pain clinic in Jacksonville.
His attorney confirmed Thorpe, 47, is still practicing medicine. A recording at the Blanding Boulevard clinic where he works says the doctor sees patients there on Fridays and Saturdays. And there is no law that says he can't.
Thorpe was charged June 7 by Savannah-Chatham Metropolitan Police with unlawful distribution of a controlled substance and unlawful prescribing related to his work at a pain clinic on Abercorn Street in Savannah. The arrest followed an almost yearlong investigation by the DEA and the local agency.
Thorpe still works at Med-West Pain Management at 4028 Blanding Blvd. in Jacksonville.
Thorpe referred comment to his attorney, Bernard Cassidy.
"We believe he committed no crime, and we will address the case in a court of law," Cassidy said.
After a search warrant was executed in Savannah in December, Agent Gene Garley of the Chatham-Savannah Counter Narcotics Team said Thorpe voluntarily stopped seeing patients.
"This was definitely considered a major investigation," Harley said. "There was a high volume of traffic. There was a mix of local and out-of-state patients."
But a few days after he posted bond in Savannah, a local pharmacist was surprised to see a prescription written by Thorpe cross his desk.
"We were curious about why he'd still be practicing if he were arrested in Savannah," said Joe Burghardt, pharmacist and co-owner of Flagler Community Pharmacy.
Florida law requires periodic background checks, but it does not require a doctor to report an arrest to the state medical board.
"Doctors are required to report convictions," said Jennifer Hirst, public information officer for the Florida Department of Health. "That is a self-reporting requirement, and if they do not report within 30 days, the board can take action."
The state board can enact emergency license suspensions and revocations if they have reason to believe patients could be endangered. Laws in Georgia are similar, requiring doctors only to report a conviction.
Thorpe's license does not currently have any restrictions, and he has no discipline record on file. Hirtz said Florida law prohibits the department from disclosing whether the state has an investigation into Thorpe, but it does routinely investigate arrests and take disciplinary action "as appropriate.
