With mounting concerns about changes in the national health care system, insurance markets are in a state of change, Shank said, and most private agents are reluctant to get involved with large group policies like the district needs. Blue Cross Blue Shield of Delaware is urging lawmakers to change a 2004 law regulating affiliations of not-for-profit health care entities.
Blue Cross pressed for the bill after Attorney General Beau Biden determined that its proposed affiliation with Pennsylvania-based Highmark Inc. amounts to a not-for-profit conversion under Delaware law.
That determination means a foundation must be created to ensure that some $175 million in reserves that Blue Cross has accrued because of its favorable tax-exempt status is protected and used for the benefit of Delawareans.
But Blue Cross says Highmark has the right to walk away from the deal if it is deemed a conversion.
