Innocence Network and others petition Oregon Supreme Court to review Samuel ...

The Innocence Network and two other groups have petitioned the Oregon Supreme Court to review, and overturn, the aggravated murder conviction of Samuel Adam Lawson, whom a Douglas County jury found guilty in the 2003 shooting of Noris Hilde at an Umpqua National Forest campground.

The amici briefs question why the trial-court jury was allowed to hear the problematic identification of Lawson as the shooter by Sherl Hilde, the victim's widow, who was critically injured in the brutal late-night sniper incident at Briggs Camp.

Earlier that August day, the Hildes returned to the campsite to find Lawson sleeping in a tent they'd set up earlier in the week.

The Hildes were annoyed, but the exchange was relatively amiable. Lawson, 28 at the time, moved his yellow truck to an adjacent campsite, then departed.

At 10 p.m., Sherl Hilde was shot in the chest as she closed a trailer window. When Noris turned the lights on to locate his wife's cell phone and call 9-1-1, he was mortally wounded.

As he lay dying, a man approached the trailer, demanding the keys to the Hildes' truck. Before leaving, he put a seat cushion over Sherl Hilde's face.

As Oregon's Court of Appeals gamely concedes, Sherl Hilde did not positively identify Lawson as the man who demanded her truck keys until two years after the shooting .

What's more, the court notes, the actions of the Douglas County sheriff's detective leading to that ID were "unduly suggestive."

Yet the Court of Appeals confirmed Lawson's conviction, arguing that a "fleeting" glance by Hilde makes her testimony "independently reliable" and worthy of the jury's consideration.

Judge Timothy Sercombe's dissent is much more persuasive.

When Hilde's "limited opportunity to view the perpetrator is combined with her generic descriptions" and "the two-year lapse of time," he writes, the evidence "fails to demonstrate that Sherl's in-court identification is reliable despite the suggestive pretrial procedures."

The amici briefs -- the other two are from the Oregon Criminal Defense Association , and a group of 11 college professors -- hammer at the same point.

The potency and prejudicial value of eyewitness testimony is so significant, the Innocence Network notes, that at least 199 people have been convicted and imprisoned "following eyewitness testimony which was later proved by DNA evidence to be dead wrong.
